  1. Noonan is right about views not being guaranteed unless you own first-tier property, or have or have purchased a view easement. Any right allowed and protected by zoning however does depend on upholding the integrity of our zoning laws. That is of paramount of importance.

    1. THE REASON FOR HEIGHT LIMITS AND SET-BACK DISTANCES IS TO CREATE AND KEEP THE OPEN SPACE AMONG BUILDINGS. VIEW IS PROTECTED IN THOSE SPACES. SO IF I HAVE AN EMPTY LOT BETWEEN ME AND THE OCEAN, AND SOMEONE BUILDS A HOUSE IN IT, I LOSE MY VIEWS EXCEPT FOR OVER 30′ AND THROUGH THE REQUIRED SETBACK AREAS. GLOUCESTER’S ZONING ORDINANCE IS UNUSUAL IN PROTECTING VIEWS THAT ARE ESSENTIALLY “SOCIAL SPACE.”

      THAT’S WHY ZBA’S GRANTING EVERY HEIGHT AND SETBACK VARIANCE THAT COMES BEFORE THEM IS MAKING GLOUCESTER INTO SOMEPLACE ELSE. ILLEGALLY. HOUSE BY HOUSE. EVEN BEFORE THE COUP.
